For Medical Malpractice Implications Call Malpractice Attorney

Providers of professional services such as legal, medical and accounting, have to adhere to a strict set of laws, rules and guidelines in the performance of their areas of expertise. It is for this reason that malpractice can be claimed against these professionals, should they not act within the confines of their scope of practice, for medical problems the services of a malpractice attorney should be sought.

The first cause of premature death in the US is heart disease, the second is cancers and the third is medical malpractice. This does not inspire a great deal of confidence in the medical profession, but these professionals have to be responsible for their actions, they chose this profession being aware of these pitfalls.

Misdiagnosis' happen and a good deal of malpractice in the medical profession is not intentional. But there are cases where malpractice occurs as a direct result of some purposeful action, this actually makes it on the border of being criminal.

I have a wonderful example, while working for the management company of a hospitals group, one of our hospitals had a practicing OB/GYN, who was guilty of deliberate malpractice. We knew it, but proving it is another matter. He would perforate the intestine of a patient "accidentally" while performing hysterectomies.

The reason why he was under suspicion, was because it only happened during hysterectomies, a simple operation and only with him. Unfortunately his patient being ignorant of medical situations believed he had saved their lives. But a disproportionately large amount of his patients now also had to live with a colostomy. It was very difficult to prove, but we believed his motivation was greed. Eventually he was removed, but under great difficulty, and no patients sued.

"An act of negligence on the part of a health care provider" is how the act of medical malpractice is defined. The negligence must also lead to additional complications or death to be proved. The example of our doctor is a prime case of intentional malpractice and his actions were criminal, but also virtually impossible to prove.

In its very nature, malpractice happens if the practitioner deviates from mainstream medical practices. These deviations include misdiagnosis as well as botched operations and childbirth deliveries as well as other cases. Every possible health care professional should be covered for malpractice insurance as they can all be held culpable in such law suits.

As far as the victim (patient) is concerned, they need to get the services of a good malpractice attorney on their side in order to bring a suit against a health professional, and claim from their insurance. Preferably the attorney should be fielded in medical matters of this nature. - 31397
