The State of Utah has just as many divorces as the rest of the United States of America. The rate of divorce in Utah is around 0.43% of the entire population, and is slightly more than the national rate of 0.41%. In Utah, the average for a first divorce is 31 for males and 29 for females.

The number of children involved in a Utah divorce is rising rapidly. In 2000, there were more than 10,000 youngsters involved in divorce and the number currently is much higher.

According to a study of statistics by Utah State University on the most recent information available, almost half of the divorces in Utah happen during the first five years of marriage. Almost 1/5 of divorces in Utah happen before the couple make it to their first wedding anniversary.

So why do many parties in Utah decide to go without representation? Attempts are being made this year (2009) by the Utah state courts to determine what proportion of divorces involve parties without legal representation. Factors to Notice When a Crime Occurs

Witnessing or being a victim of crime can be a very traumatic experience. If one witnesses a crime, it is important to make a note of the details of the crime scene and even the criminal act. This will ensure that the accused gets a fair trial and legitimate evidence is submitted at trial. Some factors to notice when a crime occurs include:

1. Physical Description of the Suspect: If you actually see the perpetrator of the crime, you should make a note of his or hers physical appearance. This includes the height, ethnicity, gender, weight, and any unusual way of running or walking. You should also make note of the clothing and any unique characteristics such as a logo, particular word, sports team name..etc. Are the clothes casual, formal, dirty, torn, bloody..etc? 3. Accessories: Did the perpetrator have a gun, bag, umbrella, knife, tire iron, baseball bat, or carrying an object such as item that could have been stolen.

4. Familiarity of the Suspect: If the suspect seems familiar, think about where you have been recently and who you have seen them. This can include: mall, retail store, school, department store, supermarket...etc. If possible, get the suspect's car license plate number.

5. Damaged Items: Note any damage that you see around the crime scene such as vandalized cars, broken windows, open door or smashed open door, open cash register, items spilled over the floor..etc.

If you witness a crime, immediately call 911. Provide as much information as you can over the phone as a recording will be made. Try to be detailed. As if a foreclosure on your home isn't bad enough, do you realize there could be dire tax consequences? Fortunately, the IRS is taking steps to mitigate much of the double disaster.

Many have accused the IRS of speaking some foreign language over the years. The goal of this, of course, is to get the most amount of milk out of taxpayers with the minimum amount of moo. The milk is money and the moo is protest. One area where a lot of mooing is occurring is with the tax consequences of being relieved from the burden of a lot of debt.

If you owe a large amount of money for something, you probably don't think of it as income in any way. Well, the IRS does in one situation. If you are relieved of a large amount of debt, the IRS views that relief as a form of income to you and it expects you to pay income taxes on it.

In the case of homeowners facing foreclosure, this can lead to disaster. If you owe $400,000 on a home and lose it to foreclosure, you have been relieved of $400,000 in debt and your home. The IRS somehow views this as a good thing and credits you with $400,000 in income and expects you to pay tax on it.

Now, there are some big mitigating factors. The primary one is you get to "deduct" the value of the home from the debt. If the home is worth $400,000 and you are relieved of $400,000 in debt, then everything is a wash and there is no tax due.

So, what happens if the home value is only $300,000? Do you now owe income tax on $100,000? Yes, but there may be an out. The IRS allows insolvent taxpayers to reduce their tax by the total amount of their debts compared to assets. If you have lost your home, you can certainly make an argument that you are close to or completely insolvent.

Assuming you are stuck with some phantom income, you may also want to consider the filing of an offer in compromise to mitigate the debt. An offer in compromise essentially tells the IRS you owe a certain amount and can't pay it based on your assets. Given the loss of your home, the IRS is known to be receptive to such arguments and greatly reduce any tax due.

Losing your home to foreclosure is bad enough. If you have additional income tax problems, it is worth your time to sit down with a tax expert and find out how to deal with it. - 31397
